It’s official - the law is getting tough on companies with employees who drive on business. Whether an employee is using a company vehicle or his/her own vehicle for business mileage, the employer is bound by the Health & Safety at Work Act 1974, the Road Traffic Act 1991 and Department for Transport legislation to ensure a certain level of compliance – and the consequences of failing to comply can be devastating.

“For the majority of people, the most dangerous thing that they do whilst at work is drive on the public highway”.

This is the government (HSE) view – and this statement represents a very realistic summary of the risks involved in today’s work-related driving.

As well as clearly having an ethical responsibility to protect employees, employers also have a legal “Duty of Care” to safeguard the health and safety of employees whilst at work, and to protect others who may be at risk from their work activities. This Duty of Care includes all work-related driving activities.
